Terms and Conditions
1. Booking & Payment
A 25% non-refundable deposit is required to secure your session date. The remaining balance is due one week prior to the scheduled session.
The 25% non-refundable deposit will not be refunded under any circumstances, including cancellations or changes to the session.
Payments can be made via cash, Cashapp or Venmo. Any payment not completed by the due date may result in cancellation of your session.
If a payment plan is requested, it must be approved in advance and adhered to as outlined.
2. Cancellations & Rescheduling
Cancellations must be made in writing (via email), or via text message at least 72 hours prior to the session for all weddings, and 24 hours prior for all other shoots.
If the session is not canceled within proper hours of the scheduled date based on shoot time, the deposit will be forfeited and no refund will be provided of paid balances.
Rescheduling requests must be requested at least 24 hours before a regular session. If the session is not rescheduled or missed without notice, it will be considered a forfeited session.
If rescheduling is necessary due to unforeseen circumstances (e.g., weather, illness), we will work with you to find an alternative date based on availability.
3. Session and Location
The client agrees to be on time for their scheduled session. If the client arrives late, the session time will be reduced accordingly. No additional time will be added, and the session will end at the originally scheduled time.
Any session scheduled outdoors is subject to change in case of bad weather. If weather conditions are unsuitable for photography, we will reschedule the session or move to an indoor location if possible. All communication will be very present between both parties and notified within 24 hours of shoot on both parties accord if rescheduling is necessary.
The client is responsible for ensuring that props, pets, or any other items brought to the session are safe and suitable for use.
4. Image Rights & Usage
All images created during the session are owned by the photographer.
The photographer retains the right to use any photos for promotional, portfolio, or marketing purposes unless otherwise agreed in writing.
The client will receive digital images in high resolution after editing. The client will be sent an email from renegaderosephotography@gmail.com when photos are ready, and is responsible for downloading the images promptly from the gallery.
5. Model Release
By booking a session, the client grants the photographer the right to use any photographs taken for promotional purposes, including but not limited to social media, websites, or advertising materials. If the client wishes to opt-out of such use, they must notify the photographer prior to the session.
6. Liability
The photographer is not responsible for any injuries, damages, or loss that may occur during the session.
The client is responsible for their own safety and the safety of their guests and pets during the shoot.
The photographer will take reasonable precautions to avoid any damage to property or injury, but is not liable for accidents or damages that may occur during the session.
7. Conduct During Session
The client agrees to cooperate with the photographer and follow all safety guidelines during the session.
Inappropriate or disruptive behavior, including failure to follow safety protocols for pets or children, may result in the immediate termination of the session without refund.
8. Force Majeure
In the event of unforeseen circumstances (e.g., natural disasters, illness, or other emergencies) preventing the photographer from fulfilling the session, a full refund will be provided for any amount paid beyond the non-refundable deposit.
The 25% non-refundable deposit will not be refunded under any circumstances, including force majeure events, but client will have the opportunity to pick a rescheduled date.
The photographer is not liable for any other damages or inconvenience caused by such circumstances.
9. Client Responsibilities
The client is responsible for communicating any special requests, locations, or preferences before the session.
If the client needs assistance with posing, props, or wardrobe, the photographer will provide guidance during the session to ensure the best results.
Legal Information
1. Copyright Ownership
All photographs taken by Renegade Rose Photography are protected by U.S. copyright laws. The photographer retains full ownership of all images. The client is granted a license to use the images for personal use only (e.g., printing for personal display, sharing on social media with mentioned credit). Commercial use of any images is prohibited without explicit permission from the photographer.
2. Privacy Policy
Renegade Rose Photography respects your privacy and is committed to protecting the confidentiality of your personal information. All client information will be stored securely and used solely for business purposes related to your booking and session.
Your personal details will never be shared with third parties without your prior consent unless required by law.
3. Indemnity
The client agrees to indemnify and hold Renegade Rose Photography harmless against any claims, damages, or expenses arising from the client’s failure to follow the terms of this agreement, or from any injuries, damages, or incidents that occur during the session.
4. Dispute Resolution
Any disputes related to the session or services provided will first be attempted to be resolved through direct communication. If a resolution cannot be reached, the dispute may be handled through mediation or arbitration in Texas following the applicable laws of the state.
If mediation or arbitration does not resolve the issue, the matter may be pursued in the courts of McLennan County, Texas.
5. Governing Law
This agreement will be governed by and construed in accordance with the laws of the state of Texas, and any disputes will be resolved in the appropriate courts in McLennan County, Texas.
Signature & Agreement
By booking a session with Renegade Rose Photography, you agree to these terms and conditions, including all clauses related to payment, cancellation, rescheduling, and image use. The client acknowledges that they have read, understood, and accepted these terms.
